Welcome to A Duck’s Therapist: Hope Counseling Services, LLC (“we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your use of our website (aduckstherapist.com), membership services, merchandise purchases, newsletters, contact forms, resource idea forum, reviews, and related services (collectively, “Services”). 1. Eligibility

To use our Services, you must:

  • Be at least 13 years old with parental or guardian consent. Users under 13 are not permitted to use our Services.

  • Not be prohibited from using our Services under applicable laws.

  • Use our Services for personal, non-commercial purposes unless otherwise agreed in writing.

Our Services are designed for parents and counselors working with children, not for children under 13.

2. Accounts and Memberships

Account Creation

To access our membership platform, purchase merchandise, or submit reviews, you may need to create an account. You agree to:

  • Provide accurate, current, and complete information during registration.

  • Keep your account credentials confidential and not share them with others.

  • Notify us immediately of any unauthorized account use at aduckstherapist@gmail.com.

Membership Subscriptions

Our membership platform, hosted on Squarespace, provides access to exclusive resources (e.g., worksheets, forums). Membership terms include:

  • Pricing: Membership fees are shown at checkout and are charged monthly.

  • Auto-Renewal: Subscriptions renew automatically until canceled.

  • Cancellation: You may cancel your membership with 7 days’ notice via your Squarespace account dashboard or by contacting us. No refunds are issued for partial billing periods.

  • Access: Membership access is non-transferable and subject to these Terms.

We reserve the right to modify membership pricing or features with 30 days’ notice via email or website announcement.

3. Merchandise Purchases

Ordering

Merchandise, including workbooks, notebooks, journals, apparel, stickers, mugs, pillows, posters, and books, is sold through our Squarespace Commerce platform or Amazon. By placing an order, you agree to:

  • Provide accurate billing and shipping information.

  • Pay all applicable fees, including taxes and shipping costs, via Stripe or PayPal (Squarespace) or Amazon’s payment processors.

  • Review your order details before submission.

Amazon Purchases

Workbooks sold through Amazon are subject to Amazon’s terms of service and standard return policy (typically 30 days), which you must review at amazon.com. We are not responsible for Amazon’s actions or policies.

Shipping

Merchandise ordered through Squarespace is fulfilled by Printify and/or Printful and shipped using standard third-party carriers (e.g., USPS, FedEx). Shipping times and costs are provided at checkout. We are not responsible for delays caused by carriers or customs.

Returns and Refunds

  • Squarespace/Printify/Printful Orders: Per Printify and Printful’s policies, you may request a refund or replacement for defective or damaged merchandise within 30 days of delivery, subject to inspection. Contact us at aduckstherapist@gmail.com to initiate a return. You are responsible for return shipping costs unless the issue is due to our, Printify’s, or Printful’s error (e.g., wrong item). Non-defective items are not returnable unless stated at purchase.

  • Amazon Orders: Returns and refunds for workbooks purchased through Amazon are governed by Amazon’s standard return policy.

  • No Refunds for Digital Products: Digital merchandise (e.g., downloadable workbooks) is non-refundable once accessed.

Warranties

Merchandise is sold with implied warranties of merchantability as required by law. No additional warranties are provided beyond those offered by Printify, Printful, or the manufacturer, if any.

4. Counseling Resources and Disclaimers

Our Services include resources like worksheets, workbooks, and blogs to support emotional intelligence and mental clarity for parents and counselors. These resources:

  • They are based on evidence-based theories such as Cognitive Behavioral Therapy (CBT) principles, or ACT (acceptance and commitment therapy), but are not a substitute for professional therapy or medical advice.

  • Should be used under the guidance of qualified professionals when applied to children.

  • Are provided “as is” without warranties of accuracy, effectiveness, or suitability.

We are not liable for any outcomes resulting from the use of our resources. Consult a licensed therapist or medical professional for personalized advice.

5. User Conduct

When using our Services, including the resource idea forum, reviews, or a separate Facebook group, you agree not to:

  • Share identifiable client information that could reveal their identity.

  • Post demeaning, offensive, or non-constructive content about or toward others.

  • Engage in unlawful, harmful, defamatory, or spamming activities.

  • Violate intellectual property or privacy rights.

  • Provide medical or therapeutic advice unless qualified and authorized.

Violations will result in a warning, followed by immediate removal from the forum or Facebook group without affecting membership or resource access. For extreme violations (e.g., repeated or severe breaches), we may terminate your membership with a warning, and no refunds will be issued for that month or year service you committed to. You will not be charged following months or year after removal. We reserve the right to remove content or suspend/terminate access for non-compliance.

6. Intellectual Property

All content on our Services (e.g., worksheets, workbooks, blogs, logos, designs) is owned by or licensed to A Duck’s Therapist: Hope Counseling Services, LLC and protected by copyright, trademark, and other laws. You may:

  • Use resources (e.g., worksheets, workbooks) for personal, non-commercial purposes as intended.

  • Not reproduce, distribute, modify, or sell our content without written permission.

User-submitted content (e.g., forum ideas, reviews) grants us a non-exclusive, royalty-free license to use, display, and distribute it in connection with our Services.

7. Third-Party Services

Our Services integrate third-party platforms, including:

  • Squarespace: Hosts our website, memberships, and eCommerce.

  • Printify and Printful: Fulfill merchandise orders.

  • Amazon: Sells workbooks.

  • Stripe and PayPal: Process payments.

  • ConvertKit: Manages newsletters (once transitioned).

  • Google Analytics and Squarespace Analytics: Track site usage.

  • Pinterest and Facebook Pixels: Deliver targeted ads.

  • Facebook Group: Facilitates member interactions.

These services are governed by their own terms and privacy policies, which you must review. We are not responsible for third-party actions or content.

8. Payments and Billing

Payments for memberships and merchandise are processed securely via Stripe or PayPal (Squarespace) or Amazon’s processors. You agree to:

  • Pay all fees and taxes displayed at checkout.

  • Authorize recurring payments for memberships until canceled.

  • Update payment information promptly to avoid service interruptions.

We are not liable for payment disputes; contact Stripe, PayPal, Amazon, or your financial institution for resolution.

9. Termination

We may suspend or terminate your access to our Services if you:

  • Violate these Terms.

  • Engage in fraudulent or unlawful activities.

  • Fail to pay applicable fees.

  • Breach conduct rules in the forum or Facebook group after a warning.

For extreme conduct violations, we may terminate your membership with a warning. You may terminate your account or membership by canceling through your Squarespace dashboard or contacting us. Upon termination, your access to paid Services will end, and no refunds will be issued for partial periods or due to conduct violations.

10. Limitation of Liability

To the fullest extent permitted by law, A Duck’s Therapist: Hope Counseling Services, LLC, its affiliates, and partners are not liable for:

  • Indirect, incidental, or consequential damages arising from your use of our Services.

  • Errors, delays, or interruptions in our Services.

  • Outcomes from using our counseling resources or merchandise.

  • Third-party actions (e.g., shipping delays, data breaches).

Our total liability is limited to the amount you paid for the specific Service causing the issue.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or losses arising from:

  • Your use of our Services.

  • Your violation of these Terms.

  • Content you submit (e.g., forum posts, reviews).

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Idaho, without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts of Ada County, Idaho. You agree to submit to their jurisdiction.
